TERMS OF SERVICE

Australia and United States | Interest-registration stage | Effective 4 August 2026

CURRENT STAGE NOTICE: Wavefront Supply currently accepts expressions of interest only. The Website does not accept payment, create paid preorders, or guarantee stock, pricing, allocation or delivery.

1. About these Terms

These Terms of Service ("Terms") govern access to and use of wavefrontsupply.com (the "Website") and the submission of interest, founding-access and allocation requests to Wavefront Supply.

By using the Website or submitting a form, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Website or submit information.

Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights available under the Australian Consumer Law and mandatory United States federal or state law.

3. Eligibility

You must be at least 18 years old, or the age of legal majority where you live, and legally able to agree to these Terms. If you act for a business or organisation, you confirm that you are authorised to act for it.

4. Interest registrations are not orders

Submitting an interest, founding-access or allocation form is not a purchase, preorder, reservation or deposit. No payment is taken and neither you nor Wavefront Supply is required to proceed with a transaction.

An interest registration does not guarantee product availability, allocation, price, discount, manufacturer, exact SKU, delivery date, warranty coverage or access to a future offer.

Wavefront Supply may contact selected registrants with verified product, pricing, allocation and preorder information. Any future purchase will be governed by the product listing, checkout disclosures, accepted order confirmation and purchase or preorder terms displayed at that time.

5. Product information and illustrative images

We aim to keep product descriptions, specifications and compatibility information accurate, but the current Website is an early-stage catalogue used to measure interest. Information may be updated as supplier and manufacturer details are verified.

Where an exact board partner or SKU has not been confirmed, product images may be original illustrative renders rather than photographs of the exact card that could later be offered. Illustrative images must not be relied on as showing a particular manufacturer, cooler, connector layout, dimensions, packaging or included accessories.

Before any paid offer is made, the relevant listing should identify the exact manufacturer and SKU, or clearly disclose any permitted substitution, together with verified commercial terms.

6. Compatibility and general information

GPU suitability and performance depend on factors including the rest of the system, case clearance, motherboard, power supply, connectors, cooling, drivers, software, workload and settings. Website information is general information and is not a guarantee of compatibility or performance for a particular system unless expressly confirmed in writing for that system.

Any discussion of AI workloads, gaming performance, cryptocurrency use, profitability, resale value or future market conditions is general information only and is not financial, investment or professional advice.

7. Email communications and consent

If you submit a form and consent to receive emails, Wavefront Supply may contact you about the GPU selected, product allocations, founding access, verified pricing and preorder information.

You may unsubscribe from marketing emails at any time using the unsubscribe link in the message or by contacting hello@wavefrontsupply.com. Transactional or legally required messages may still be sent where applicable.

Your personal information is handled in accordance with the Privacy Policy.

8. Acceptable use

You must not misuse the Website. Prohibited conduct includes:

attempting unauthorised access or interfering with Website security or availability;

introducing malicious code or using automated tools at an abusive rate;

submitting fraudulent, misleading or impersonated information;

infringing intellectual-property, privacy or other rights; or

using the Website in violation of applicable law.

We may restrict access or disregard registrations where reasonably necessary to protect the Website, users, suppliers or legal compliance.

9. Intellectual property and trade marks

Unless stated otherwise, the Wavefront Supply branding, original text, website design, original graphics and other original content are owned by or licensed to Wavefront Supply and are protected by applicable intellectual-property laws.

AMD, Radeon and all third-party manufacturer names, logos and trade marks belong to their respective owners. Their use to identify products or compatibility does not imply sponsorship, endorsement, affiliation or authorised-reseller status unless expressly stated.

10. Third-party services and links

The Website may use or link to Shopify, Shopify Forms, Google Workspace, analytics providers, email providers, social platforms and other third-party services. Those services may have their own terms and privacy policies.

We are not responsible for independent third-party websites or services outside our control. This does not remove responsibility for our own conduct, representations or legal obligations.

11. Website availability and changes

We may update, correct, maintain, suspend or discontinue Website content or features. We do not promise uninterrupted or error-free access.

We may update these Terms prospectively by posting a revised version with a new effective date. Changes do not create a paid obligation or retrospectively alter an accepted purchase contract.

12. No current sales contract

Because the Website does not currently accept payment or orders, these Terms do not contain the final shipping, returns, warranty, preorder-cancellation, tax, import-duty or delivery provisions that will apply to future sales.

Before payment is accepted, Wavefront Supply will publish or display the applicable purchase terms, including the exact product, price, currency, taxes, shipping or dispatch estimate, cancellation and refund rules, warranty position and any import charges.

13. Consumer rights

Nothing in these Terms excludes or limits rights that cannot be excluded. If Wavefront Supply later supplies goods to an Australian consumer, the Australian Consumer Law may provide non-excludable guarantees and remedies. United States customers may also have mandatory federal and state consumer rights.

No statement on the Website should be interpreted as removing a mandatory right or remedy.

14. Disclaimers and liability

To the extent permitted by law, Website content is provided for general information during the interest-validation stage and may contain preliminary or incomplete information. You should not make a purchase, investment or system-design decision solely from preliminary catalogue content.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud, wilful misconduct or a breach of a mandatory consumer or privacy obligation.

To the extent permitted by law, Wavefront Supply is not liable for indirect or consequential loss arising solely from reliance on preliminary interest-stage information where that loss was not reasonably foreseeable.

15. Governing law and disputes

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia that apply there. The courts and tribunals with jurisdiction in New South Wales have non-exclusive jurisdiction.

This choice of law does not deprive a consumer in Australia or the United States of mandatory rights, protections, venues or remedies available under the law that applies to them.

Please contact hello@wavefrontsupply.com first so we can try to resolve a concern promptly. Nothing prevents a person from contacting a regulator, consumer-protection agency, court or tribunal available to them.

16. General

If a provision of these Terms is invalid or unenforceable, it will be read down or severed only to the minimum extent necessary, and the remaining provisions continue.

A delay in exercising a right is not a waiver. These Terms and the Privacy Policy form the current agreement governing use of the Website and interest registrations.
