Wavefront Supply ("Wavefront Supply", "we", "us" or "our") is operated by Caleb Bacon, sole trader, ABN 18 875 938 124, from New South Wales, Australia.

This Privacy Policy explains how we collect, use, disclose, retain and protect personal information when people visit wavefrontsupply.com, submit a Shopify form, communicate with us, or exercise privacy rights.

This Policy is intended to address our current activities in Australia and the United States. Privacy rights vary by location, and some rights described below apply only where the relevant law applies to us and to the person making the request.

3. Personal information we collect

Depending on how you interact with us, we may collect:

contact details, such as your first name and email address;

interest-registration information, such as the GPU model you select, intended use and optional project notes;

marketing choices, including whether, when and how you consented to receive emails and any unsubscribe request;

communications you send to us, including support or privacy enquiries;

technical and usage information, such as IP address, approximate location derived from IP, browser, device, operating system, pages viewed, links clicked, referring page and timestamps;

security and fraud-prevention information generated by Shopify or other service providers; and

any other information you choose to provide.

The current Website does not accept payment or create paid orders. We therefore do not currently collect payment-card details through the Website. Before paid checkout opens, this Policy will be reviewed and updated to describe the additional order, payment, shipping and warranty information collected.

4. How we collect information

We collect information directly from you when you submit a form, email us, request support or otherwise communicate with us.

We collect some technical and usage information automatically through Shopify, cookies and similar technologies when you use the Website.

We may also receive information from service providers that help operate the Website, forms, email, security, analytics and customer communications.

5. Why we use personal information

We may use personal information to:

record and respond to GPU interest, founding-access and allocation requests;

send emails you requested or consented to receive about selected GPUs, verified pricing, allocation and preorder details;

answer enquiries and provide customer support;

understand demand, improve the Website and plan future products and services;

operate, secure, troubleshoot and prevent misuse of the Website and forms;

maintain records of consent, unsubscribe requests and privacy requests;

comply with legal, regulatory, accounting and dispute-resolution obligations; and

establish, exercise or defend legal claims.

6. Marketing communications

We send marketing or product-allocation emails where you have provided consent or where another lawful basis applies. The current signup form is intended to obtain express consent for emails about the selected GPU, Wavefront Supply allocations and preorder details.

You may unsubscribe at any time using the unsubscribe link in an email or by contacting hello@wavefrontsupply.com. We may retain a suppression record so that we do not send marketing to an address that has opted out.

Service, security, privacy-request or legally required messages may still be sent where they are not marketing communications.

7. Cookies and similar technologies

The Website uses cookies and similar technologies for essential operation, security, preferences, performance and analytics. Shopify and other service providers may set or read these technologies when they provide services to us.

Available privacy controls may include a cookie banner, browser settings and any data-sharing opt-out control made available through Shopify. Blocking some cookies may affect Website functionality.

8. When we disclose personal information

We may disclose personal information to:

Shopify and its service providers, which host and operate the Website, forms and customer records;

Google Workspace and other communications providers used to send, receive and store business email;

hosting, security, analytics, technical-support and professional-service providers;

accountants, lawyers, insurers, advisers and auditors;

government agencies, regulators, courts or law-enforcement bodies where required or authorised by law; and

a genuine buyer, investor, financier or successor in connection with a proposed business sale, restructure or transfer, subject to appropriate safeguards.

We do not sell personal information as a standalone product and do not sell personal information for money. If future advertising or data-sharing practices are treated as a "sale", "sharing" or targeted advertising under an applicable United States state law, we will provide any notice and opt-out mechanism required by that law.

9. Overseas and cross-border processing

Wavefront Supply is based in Australia and serves people in Australia and the United States. Shopify, Google and other service providers operate internationally. Personal information may therefore be processed in Australia, Canada, the United States and other countries where our providers operate.

Privacy protections and government-access rules may differ between countries. Where applicable law requires it, we will take reasonable steps in relation to overseas disclosures or rely on another lawful basis.

10. Retention and deletion

We generally retain interest-registration records for up to 24 months after the last meaningful interaction, unless you unsubscribe or request deletion sooner, a longer period is reasonably needed for security, legal or dispute purposes, or law requires retention.

Consent and suppression records may be retained for longer where reasonably necessary to demonstrate consent and honour unsubscribe requests. Technical logs and backups may be kept for different periods based on security, operational and legal needs.

When personal information is no longer reasonably required, we take reasonable steps to delete or de-identify it, subject to lawful retention and backup cycles.

11. Security

We use reasonable administrative, technical and organisational safeguards appropriate to the information and risks involved. These may include access controls, account security, reputable service providers, encryption in transit, software updates and limited access.

No online system is completely secure. We cannot guarantee absolute security, but we will respond to suspected incidents in accordance with applicable law.

12. Australian privacy rights and complaints

Where Australian privacy law applies, you may request access to personal information we hold about you and ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.

You may also make a privacy complaint by emailing privacy@wavefrontsupply.com. We may need to verify your identity and will respond within a reasonable period. Where the Privacy Act 1988 applies and you are not satisfied with our response, you may be able to complain to the Office of the Australian Information Commissioner.

13. United States state privacy rights

Depending on your state of residence and whether the relevant law applies to us, you may have rights to:

confirm whether we process your personal data and access a copy;

correct inaccurate personal data;

delete personal data, subject to legal exceptions;

receive portable data in a usable format;

opt out of sale, sharing, targeted advertising or certain profiling;

limit certain uses of sensitive personal information;

appeal a privacy-request decision where applicable; and

receive service without unlawful discrimination for exercising privacy rights.

To submit a request, email privacy@wavefrontsupply.com. You or an authorised agent may make a request where permitted. We may ask for information reasonably necessary to verify identity, residence or authority.

14. California notice

This section applies to California residents only to the extent the California Consumer Privacy Act, as amended, applies to Wavefront Supply.

The categories of information we may collect are described in section 3. We collect them from the sources described in section 4, use them for the purposes in section 5, and disclose them to the categories of recipients in section 8.

Where applicable, California residents may request to know, access, correct or delete personal information and may opt out of sale or sharing. We do not currently sell personal information for money and do not offer a financial incentive tied to personal information.

Where required by law and technically supported, we will process a recognised opt-out preference signal, such as Global Privacy Control, as an opt-out request for the browser or device sending the signal.

15. Children and age limits

The Website is not directed to children under 13, and we do not knowingly collect personal information online from a child under 13. If you believe a child has submitted information, contact privacy@wavefrontsupply.com.

Interest forms and any future purchases are intended for people who are at least 18 years old or the age of legal majority where they live.

16. Third-party websites and services

The Website may link to or use independent third-party services with their own privacy policies. We are responsible for our own privacy practices but do not control an independent third party’s separate services.

17. Changes to this Policy

We may update this Policy to reflect changes in our business, technology, service providers or legal requirements. We will post the updated version with a new effective date and provide additional notice where required.
